Daniel Habib joined the Federal Defenders in 2014. He has represented clients in both appeals and trials. Significant matters include: United States v. Castillo, 36 F.4th 431 (2d Cir. 2022) (vacating and remanding sentence; holding that New York offense of attempted second-degree gang assault is not “crime of violence” under Sentencing Guidelines); United States v. Cabrera, 13 F.4th 140 (2d Cir. 2021) (vacating conviction and remanding for new trial based on instructional and evidentiary errors); United States v. Solano, 966 F.3d 184 (2d Cir. 2020) (vacating conviction and remanding for new trial based on plainly erroneous jury instruction); United States v. Parkins, 935 F.3d 63 (2d Cir. 2019) (vacating condition of supervised release); United States v. Vinas, 910 F.3d 52 (2d Cir. 2018) (vacating conviction and remanding for new trial based on discovery violation); United States v. Townsend, 897 F.3d 66 (2d Cir. 2018) (vacating and remanding sentence; holding that New York offense of fifth-degree criminal sale of a controlled substance is not “controlled substance offense” under Sentencing Guidelines); United States v. Mota, 155 F. Supp. 3d 461 (S.D.N.Y. 2016) (suppressing physical evidence and post-arrest statement); United States v. Gonzalez, 2015 WL 3443942 (S.D.N.Y. May 29, 2015) (dismissing illegal re-entry indictment); United States v. Rutherford, 71 F. Supp. 3d 386 (S.D.N.Y. 2014) (suppressing physical evidence).

Mr. Habib is a graduate of Harvard University and Yale Law School. He clerked for the Honorable William Fletcher of the United States Court of Appeals for the Ninth Circuit and the Honorable Sonia Sotomayor of the Supreme Court of the United States. Before joining the Federal Defenders, Mr. Habib was a managing associate at Orrick, Herrington & Sutcliffe.
