Federal Defenders of New York Position Announcement: Director of Strategic Litigation

The Federal Defenders of New York (FDNY) is seeking to hire two Directors of Strategic Litigation, one each for the Eastern District of New York and the Southern District of New York. Each position would be a management-level attorney position.

FDNY is a nonprofit organization providing criminal defense services to persons who cannot afford an attorney charged with federal crimes throughout New York City, Long Island, and several counties north of New York City. We have offices in Manhattan, Brooklyn, White Plains, and Central Islip. We are not a government agency and our employees are not government employees. Our mission is straightforward: although we provide our services free of cost, our clients should receive the finest legal representation available at any price. We are looking for someone with extensive criminal defense experience and a demonstrated commitment to combatting racism and inequality in the criminal legal system.

Position Description: Among other duties, each Director will oversee and develop litigation strategies and non-litigation advocacy aimed at combatting racism and inequality in the federal criminal legal system. Duties will include assisting, supervising, and training FDNY attorneys on anti-racist advocacy and strategies in all phases of their representation. Examples might include equal protection challenges to certain classes of prosecutions or fair cross-section challenges to jury pools. Where appropriate, the Director will also work with CJA Panel attorneys on these same issues and assist with training programs directed at the wider defense bar. In addition to developing and overseeing traditional litigation strategies, the Director will engage in non-litigation advocacy with the Court and United States Attorney’s Office. The successful applicant will have a voice in shaping and defining the position and thus the position may include additional management and supervisory responsibilities.

In addition to management duties, the Director will be expected to engage in a significant amount of direct client representation. The amount of case work will vary depending on the needs of the office, but the Director should anticipate a minimum of one-half to three-quarters of the ordinary caseload of a staff trial attorney.

Qualifications: The successful applicant must have extensive criminal defense experience and a demonstrated commitment to combatting racism and inequality in the criminal legal system.

Salary and Benefits: Salary depends on experience and is consistent with the federal pay scale. Benefits are similar to those offered to staff attorneys.
